1. General provisions

1.1. These Terms of Service govern the use of the Dzieciaki application (hereinafter: "Service").

2. Definitions

• Service - Dzieciaki mobile and web application
• User - person using the Service
• Account - set of User data in the Service
• Content - posts, photos, comments published by the User

3. Terms of use

3.1. The Service is intended for users who are 18 years of age or older.

3.2. Using the Service requires:

• Having an active email address
• Acceptance of these Terms of Service
• Acceptance of the Privacy Policy

3.3. User can create an Account by:

• Registration with email and password
• Login through Google
• Login through Facebook

4. Registration and Account

4.1. During registration, the User agrees to provide truthful information.

4.2. The User is responsible for maintaining the confidentiality of the Account password.

4.3. The User may not share their Account with other persons.

4.4. In case of suspected unauthorized access to the Account, the User should immediately change the password and inform the Administrator.

5. Publishing content

5.1. User can publish in the Service:

• Posts about their children
• Photos of children
• Comments on other Users' posts (if functionality is available)

5.2. User declares that:

• They have the rights to published content (especially photos)
• They have consent from the other parent to publish photos of the child (if applicable)
• Content does not violate the rights of third parties

5.3. It is forbidden to publish content:

• Illegal
• Violating the rights of third parties (including copyrights, personal rights)
• Offensive, vulgar, pornographic
• Promoting violence, hatred, discrimination
• Containing spam or advertisements without Administrator's consent

5.4. Administrator reserves the right to remove content violating the Terms of Service without prior notice.

6. Content rights

6.1. User retains full copyright to published content.

6.2. By publishing content, the User grants the Administrator a non-exclusive, free license to use the content to the extent necessary to provide the Service.

6.3. The license expires upon deletion of content by the User or deletion of the Account.

7. Administrator's liability

7.1. Administrator makes every effort to ensure that the Service operates continuously and correctly, but does not guarantee the absence of technical interruptions.

7.2. Administrator is not responsible for:

• Content published by Users
• Damages resulting from the use of the Service
• Data loss in case of technical failure (we recommend regular backups of important photos)

7.3. Administrator reserves the right to:

• Temporarily suspend the Service for maintenance
• Introduce changes to Service functionality
• Close the Service (with 30 days' notice)

8. Account deletion

8.1. User can delete their Account at any time from the application settings.

8.2. After Account deletion:

• Account is marked for deletion (soft delete)
• User has 30 days to restore the Account (by logging in again)
• After 30 days, all data is permanently deleted

8.3. Administrator may delete User's Account in case of:

• Violation of Terms of Service
• Publishing prohibited content
• Inactivity for more than 2 years (with 30 days' notice by email)

9. Personal data protection

9.1. The rules for processing personal data are defined in the Privacy Policy.

9.2. By using the Service, the User consents to the processing of their personal data in accordance with the Privacy Policy.

10. Final provisions

10.1. Administrator reserves the right to change the Terms of Service. Users will be informed of changes by email or in-app notification.

10.2. Continued use of the Service after changes means acceptance of the new Terms of Service.

10.3. In matters not regulated by the Terms of Service, the provisions of Polish law shall apply.

10.4. All disputes will be resolved by the court with jurisdiction over the Administrator's registered office.
